1. About these terms
These Terms & Conditions govern applications for, purchases of and use of PerkCircle consumer membership.
They form an agreement between:
PerkCircle, operated by Jamie Wassall, referred to as “PerkCircle”, “we”, “us” or “our”;
and
the individual applying for or purchasing membership, referred to as the “Member”, “you” or “your”.
By submitting an application, purchasing membership or using a PerkCircle membership card, you confirm that you have read and accepted these Terms & Conditions.
Your agreement consists of:
These Terms & Conditions;
Your completed membership application;
The membership price and period displayed when you apply;
Your confirmation email; and
Any specific conditions clearly shown before purchase.
Your statutory consumer rights are not affected by these terms.
2. About PerkCircle
PerkCircle is a local membership rewards scheme designed to connect eligible local residents with participating independent businesses.
Members receive a personalised membership card which may be presented at participating businesses to access the offers published through PerkCircle.
PerkCircle administers the membership scheme and promotes participating businesses. It does not normally sell or supply the products or services provided by those businesses.
3. Membership eligibility
To apply for PerkCircle membership, you must:
Be aged 16 or over;
Permanently reside within the relevant published membership area;
Provide acceptable evidence of your home address;
Provide any identification reasonably required to verify your application;
Provide an appropriate photograph for your membership card;
Supply accurate and complete application information; and
Pay the applicable membership fee.
Applicants under 18 may be asked to provide confirmation from a parent or guardian where reasonably required.
Membership is intended for individuals acting for personal purposes. It is not intended for resale or commercial use.
PerkCircle may decline an application where eligibility cannot be verified or the application is incomplete, inaccurate, fraudulent or otherwise does not comply with these terms.
If payment has been taken and an application is declined, the membership fee will be refunded unless the application involved fraud or another legal reason permits a deduction.
4. Membership area
Each PerkCircle membership relates to a specific geographical area.
The initial membership area covers Whitby and the published surrounding 10-mile area, as shown on the PerkCircle website.
You must permanently reside within that area when applying and when renewing.
PerkCircle may request evidence such as:
A recent utility bill;
Council Tax documentation;
A bank statement;
A driving licence;
Another document showing your current home address; or
Other reasonable proof of residence.
The documents accepted and any date requirements will be explained during the application process.
Membership cannot be transferred from one PerkCircle location to another.
If you move outside the membership area during your current membership period, you should notify us. We may permit the membership to continue until its existing expiry date, but you may not be eligible to renew for that location.
5. Membership options and prices
The standard PerkCircle membership fees are currently:
£25 for applications made during the first eight months of the membership year; and
£15 for applications made during the final four months of the membership year.
Unless stated otherwise, the first eight months run from 1 April to 30 November, and the final four months run from 1 December to 31 March.
PerkCircle may also offer a shorter winter or introductory membership at a reduced price. The applicable:
Price;
Start date;
Expiry date; and
Membership benefits
will be clearly displayed before purchase.
All prices will be shown before you complete your application.
We may change membership prices for future applications or membership years. A price change will not alter the fee already paid for an existing membership.
6. Membership period
The standard PerkCircle membership year runs from:
1 April to 31 March
All standard memberships expire on 31 March, regardless of the date on which they were purchased.
Purchasing later in the membership year does not extend membership beyond the following 31 March.
Any introductory membership will run for the dates displayed at the time of purchase and will normally end on 31 March before the first standard annual membership year begins.
Your exact membership dates will appear on your confirmation email and membership card.
7. Applications and contract formation
Submitting an application does not automatically guarantee membership.
Your application is accepted, and the contract begins, when PerkCircle:
Confirms that your application has been approved; and
Sends you a membership confirmation email.
We may contact you where further information, a different photograph or additional evidence of residence is required.
You are responsible for ensuring that the:
Name;
Home address;
Email address;
Photograph; and
Other information
supplied in your application are accurate.
You must notify us promptly if you identify an error.
8. Starting your membership
Your membership becomes active on the date shown in your confirmation email or on your membership card.
Where you purchase membership online and ask for it to begin during your statutory cancellation period, you expressly request that PerkCircle starts supplying the membership service immediately.
You cannot redeem an in-person business offer unless you can present the required valid membership card.
9. Renewals
PerkCircle memberships do not renew automatically.
We may contact you before your membership expires and invite you to purchase membership for the next membership year.
You will not be charged for a renewal unless you actively choose to renew and complete the required payment.
Failure to renew means your membership and right to use the card will end on the expiry date shown.
Renewal is subject to:
Continued eligibility;
The membership price applying at the time;
The membership area then in force; and
The Terms & Conditions applying to the new membership year.
10. Statutory cooling-off period
Where you purchase membership online, by telephone or through another qualifying distance or off-premises method, you will normally have the legal right to cancel within 14 days after the day the contract is made, without giving a reason.
To cancel, you must send us a clear statement confirming your decision. You may use the model cancellation form at the end of these terms, but you do not have to use it.
Where you expressly request that membership begins during the 14-day cancellation period and then cancel during that period, we may deduct a proportionate amount for the membership service already provided, where permitted by law.
Any refund legally due will be provided without undue delay and using the original payment method unless another method is agreed. The Consumer Contracts Regulations require businesses to provide cancellation information and permit a proportionate charge where a service starts during the cooling-off period at the consumer’s express request.
You must stop using the membership and membership card after notifying us that you wish to cancel.
The statutory cooling-off right may not apply to a membership purchased entirely face-to-face at business premises. This does not affect any other rights you may have.
11. Cancellations and refunds after the cooling-off period
After any statutory cooling-off period has ended, membership fees are normally non-refundable because membership is purchased for a fixed period ending on the stated expiry date.
A refund will not normally be provided merely because:
You choose not to use your membership;
You do not achieve a particular level of savings;
You lose or damage your card;
You move outside the membership area;
An individual business leaves PerkCircle;
A particular offer changes or ends;
A business temporarily closes;
A business’s products or services are unavailable; or
You forget to present your card.
This does not limit your right to a refund or another remedy where required by consumer law, including where PerkCircle materially fails to provide its own service as agreed.
Where PerkCircle permanently ends your membership without fault on your part, we will consider an appropriate refund for the unused membership period unless the service is being replaced with a substantially equivalent arrangement.
Consumer contract terms cannot remove statutory rights or impose disproportionate cancellation consequences.
12. Membership cards
An accepted Member will receive:
A personalised PerkCircle membership card; and
A membership confirmation email.
The membership card will normally display:
The Member’s name;
The Member’s photograph;
A membership number;
The relevant PerkCircle area; and
Membership validity dates.
Membership cards remain the property of PerkCircle.
The card must not be:
Altered;
Copied;
Digitally reproduced for use;
Lent to another person;
Sold;
Transferred; or
Used after expiry or cancellation.
You should check the card when received and promptly report any printing error.
Where a card contains an error caused by PerkCircle, we will provide a corrected replacement without charge.
13. Lost, stolen or damaged cards
You must notify PerkCircle promptly if your membership card is:
Lost;
Stolen;
Damaged;
Copied; or
Used without permission.
A replacement card is currently subject to a £5 administration fee.
We may invalidate the previous card and issue a new membership number.
A replacement fee may be changed in future, but the applicable amount will be confirmed before you order a replacement.
PerkCircle is not responsible for rewards refused before a replacement card is issued where a valid card cannot be presented.
14. Using your membership
You must present your valid PerkCircle card before purchasing, ordering or paying, as required by the participating business.
The card may only be used by the individual:
Named on the card; and
Whose photograph appears on it.
The named Member must be present when the offer is redeemed.
A participating business may ask to inspect the card to check:
The photograph;
The name;
The validity dates; and
Whether the offer conditions have been met.
Businesses may refuse an offer where:
No valid card is presented;
The photograph does not match the person;
The card has expired or been cancelled;
The card appears altered or copied;
The named Member is not present; or
The published offer conditions have not been met.
A business may choose to honour an offer where a card has been forgotten, but it is not required to do so.
15. One card per table
For restaurants, cafés and other table-service businesses, one valid PerkCircle card will normally cover the eligible table bill, provided the named cardholder is present.
The other guests at the table do not normally need to be PerkCircle members.
The exact scope of the reward remains subject to the published offer, which may include:
A maximum party size;
Excluded items;
A maximum discount;
A minimum spend;
Valid days or times; or
Another clearly stated limitation.
Where a business listing states a different arrangement, the conditions shown on that listing will apply.
For purchases that are not table-based, the offer applies only in the manner described on the relevant business listing.
16. Participating business offers
Each participating business independently chooses the offer it provides.
Offers may include:
Percentage discounts;
Fixed-value discounts;
Complimentary items;
Rewards with qualifying purchases;
Upgrades;
Member-only packages;
Seasonal promotions; or
Other benefits.
Offers have no cash value and cannot be exchanged for cash unless specifically stated.
PerkCircle membership does not guarantee that:
Every offer will suit every Member;
Every business will provide the same level of discount;
A minimum number of offers will be available in each category;
You will save more than the membership fee; or
Every participating business will remain in the scheme for the full year.
You should review the current business listing before making a journey, purchase or reservation.
17. Offer conditions
Businesses may attach reasonable conditions to their offers, including:
Minimum spending requirements;
Selected days or times;
Product or service exclusions;
Advance-booking requirements;
Maximum party sizes;
Maximum redemption limits;
Seasonal availability;
Dine-in or collection restrictions; or
Stock or capacity limitations.
These conditions will be displayed on the PerkCircle website where provided.
You are responsible for checking and meeting the conditions before attempting to redeem an offer.
Unless the listing states otherwise, a PerkCircle offer cannot be used with another:
Discount;
Voucher;
Promotional code;
Loyalty reward;
Staff discount; or
Special offer.
18. Final redemption dates
Every PerkCircle business offer will have a published final redemption date.
The final redemption date is the last date on which the reward can actually be used.
For example, if the final redemption date is 31 March:
The meal must take place by 31 March;
The appointment must take place by 31 March;
The purchase must be completed by 31 March; or
The relevant service must be received by 31 March.
Making a booking before the final redemption date does not normally extend the offer beyond that date.
A booking for a visit after the final redemption date will not qualify unless the published offer specifically states otherwise.
Your PerkCircle membership must also be valid when the reward is redeemed.
19. Reservations and changed offers
A participating business is expected to honour the terms of an offer that applied when a qualifying reservation was made where:
The reservation was made while the offer was published and active;
The visit takes place on or before the offer’s final redemption date;
The Member’s own membership remains valid;
The named cardholder is present;
A valid membership card is shown; and
All other published conditions are met.
Where a business later changes its offer, a qualifying reservation made under the previous offer should continue to be honoured under the previous published terms.
You should mention PerkCircle when booking if the offer requires advance booking.
Keep any booking confirmation where an offer influenced your decision to make the reservation.
20. Changes to business offers
Participating businesses may change their core offer during the membership year.
PerkCircle requires Business Partners to maintain an active offer throughout their agreed participation period, but the value, wording and conditions of that offer may change.
Any replacement offer will be published with its own final redemption date.
PerkCircle may immediately remove, correct or suspend an offer where:
It is inaccurate;
It may be unlawful;
It creates a safety concern;
The business has closed;
The business can no longer provide it;
The listing contains a clear error; or
Removal is reasonably necessary to protect Members or businesses.
Changing one or more individual offers does not automatically entitle a Member to cancel or receive a refund, but this does not affect any statutory right arising from a material failure of the overall membership service.
21. Participating businesses
Participating businesses are independent from PerkCircle.
They remain responsible for:
Their prices;
Their offer;
Their products and services;
Product quality and safety;
Food information and allergy management;
Availability and stock;
Bookings and cancellations;
Customer service;
Refunds relating to their goods or services; and
Compliance with applicable law.
The term “Business Partner” describes participation in the PerkCircle scheme only. It does not mean that PerkCircle owns, operates or legally partners with the business.
A business may occasionally:
Close;
Change ownership;
Become insolvent;
Temporarily stop trading;
Leave PerkCircle; or
Be removed from the scheme.
PerkCircle will update its website as soon as reasonably practical after becoming aware of a relevant change.
22. Problems with an offer
If a participating business refuses to honour an offer that you reasonably believe applies, you should first:
Check the published conditions;
Politely show the relevant listing to the business; and
Ask the business to review the issue.
If the matter is not resolved, contact PerkCircle and provide:
Your membership number;
The business name;
The date and approximate time;
The offer you attempted to use;
Details of what happened; and
Any relevant receipt or booking confirmation.
We may contact the business, investigate the listing and request corrective action.
PerkCircle cannot guarantee that a business will provide a particular discount, refund or compensation, and we cannot determine disputes concerning the quality of goods or services supplied by the business.
23. Member behaviour
Members must behave reasonably and respectfully towards:
Participating businesses;
Their staff;
Other customers; and
PerkCircle representatives.
You must not:
Share or transfer your card;
Falsify an application or supporting document;
Alter or reproduce a membership card;
Attempt to use an expired or cancelled membership;
Misrepresent the terms of an offer;
Repeatedly attempt to claim a reward contrary to its conditions;
Use membership fraudulently;
Resell or commercially exploit rewards;
Threaten, harass or abuse business staff; or
Damage the reputation or operation of the scheme through deliberate misuse.
Being dissatisfied with a business or offer does not prevent you from making a reasonable complaint.
24. Suspension or cancellation by PerkCircle
PerkCircle may suspend or cancel membership where there is reasonable evidence that:
The card has been shared;
Fraudulent or misleading information was supplied;
Eligibility requirements were not met;
The membership or an offer has been abused;
The card has been altered, copied or resold;
The Member has acted abusively or unlawfully;
Payment has been fraudulently reversed;
These terms have been seriously or repeatedly breached; or
Suspension is reasonably necessary to investigate suspected misuse.
Where appropriate, we will explain the concern and give you a reasonable opportunity to respond.
We may act immediately where the matter involves suspected fraud, safety, abuse or serious misconduct.
A membership cancelled because of the Member’s serious breach will normally be non-refundable, except where a refund is required by law.
The membership card must no longer be used after suspension, cancellation or expiry.
25. Changes to the PerkCircle scheme
The number and identity of participating businesses will naturally change over time.
PerkCircle may:
Add or remove businesses;
Add, remove or reorganise business categories;
Update the website;
Change how membership cards are verified;
Introduce additional membership features;
Correct inaccurate information; or
Make reasonable operational changes.
We will not deliberately remove the essential nature of an existing paid membership without good reason.
If PerkCircle makes a material change during your fixed membership period which significantly reduces the service you purchased and which is not required by law or caused by circumstances outside our reasonable control, we will provide an appropriate remedy where required, which may include cancellation and a proportionate refund.
26. Website availability and accuracy
We take reasonable care to keep the PerkCircle website and business listings accurate and available.
However:
Listings may rely on information supplied by businesses;
Opening times may change;
Offers may be updated;
Stock or appointments may be unavailable;
Technical interruptions may occur; and
Errors may occasionally appear.
You should check important details directly with the business before making a special journey or incurring significant expense.
Please notify us if you identify incorrect information.
27. Intellectual property
PerkCircle owns or is licensed to use its:
Name;
Logo;
Branding;
Website content;
Membership-card designs;
Printed materials;
Illustrations;
Photographs; and
Other promotional materials.
You may use these materials only for personal use connected with your membership.
You must not copy, reproduce, modify, sell or commercially use PerkCircle materials without permission.
Logos and materials belonging to participating businesses remain the property of their respective owners.
28. Our responsibility to you
PerkCircle will provide its membership administration service with reasonable care and skill, as required by consumer law.
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill.
We are not responsible for loss or damage that:
Was not reasonably foreseeable;
Was caused by inaccurate information supplied by a participating business;
Results from a business’s goods or services;
Results from a business closure or lack of availability;
Results from your failure to check published conditions;
Results from your misuse of membership; or
Is a business or commercial loss, as membership is intended for personal use.
Nothing in these terms excludes or limits liability for:
Death or personal injury caused by negligence;
Fraud or fraudulent misrepresentation;
Breach of statutory consumer rights; or
Any liability that cannot lawfully be excluded.
Consumer terms cannot exclude mandatory statutory rights or avoid responsibility for services that were not provided with reasonable care and skill.
29. Privacy and personal information
PerkCircle may process information including your:
Name;
Photograph;
Address;
Contact details;
Proof of residence;
Identification information;
Membership number;
Payment information; and
Communications with us.
This information may be used to:
Assess your eligibility;
Process your application;
Produce and administer your membership card;
Prevent fraud and card sharing;
Communicate about your membership;
Handle replacements, complaints and renewals; and
Comply with legal obligations.
Participating businesses will normally only need to see the information printed on your membership card when verifying membership.
Personal information will be handled in accordance with the PerkCircle Privacy Policy and applicable UK data-protection law.
PerkCircle will not sell your personal information to advertisers.
Optional marketing messages will only be sent in accordance with your communication preferences and applicable law. Essential membership and operational messages may still be sent.
30. Changes to these terms
We may update these terms where reasonably necessary to reflect:
Changes in law;
Security requirements;
Changes to the operation of PerkCircle;
New features;
Changes to membership administration; or
Clarification of existing wording.
The latest version will be published on the PerkCircle website.
The version accepted when you purchased membership will normally continue to apply during that membership period.
Where a legal or necessary operational change must apply sooner, we will provide reasonable notice where practical.
If a change materially disadvantages you during an existing paid membership period, we will provide any cancellation or refund remedy required by law.
Consumer terms must be transparent, fair and not excessively weighted in favour of the trader.
31. Complaints
Questions or complaints about PerkCircle should first be sent through the Contact Us page on our website.
Please provide:
Your name;
Membership number;
Contact details;
A clear description of the issue; and
Any relevant evidence.
We will aim to acknowledge and investigate complaints within a reasonable period.
Complaints concerning a participating business’s goods, services, staff or premises should normally also be raised directly with that business.
Nothing in this section prevents you from seeking independent consumer advice or exercising your legal rights.
32. Communications
We may contact you using the email address, postal address or telephone number supplied in your application.
You must keep your contact information current.
Email may be used to provide:
Application confirmation;
Membership information;
Important service notices;
Renewal invitations;
Terms updates;
Security notices; and
Responses to enquiries or complaints.
You should ensure emails from PerkCircle are not blocked or directed to your spam folder.
33. Transfer of rights
Your membership is personal and cannot be sold, assigned or transferred to another person.
PerkCircle may transfer operation of the membership scheme to another legal entity as part of a genuine business sale or reorganisation, provided this does not materially reduce your rights.
We will notify Members of any material transfer where required.
34. If part of these terms is invalid
If a court or other competent authority finds part of these terms invalid or unenforceable, the remaining provisions will continue to apply.
The invalid provision will be treated as adjusted only to the minimum extent necessary.
35. Delays in enforcement
If PerkCircle does not immediately enforce a provision of these terms, this does not mean that the provision has been waived.
36. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
Any dispute may be brought before the courts of England and Wales, subject to any mandatory consumer right allowing proceedings to be brought in another appropriate part of the United Kingdom.
